AGREEMENT OF SALE

 

 

 

 

HEALTH:  TouchGold Bengals guarantees this kitten to be free of infectious disease for seven days following the date of purchase, or date of delivery, whichever is later.  Buyer must have the kitten examined by a Veterinarian during this period, and if infectious disease is present, TouchGold Bengals will accept return of the kitten at Buyer’s expense and provide a replacement of equal value as soon as possible.  A written diagnosis from Buyer’s Veterinarian must be provided.  If no suitable replacement is available for six months after the return of the kitten, a full refund of the purchase price will be given to the Buyer.  Alternatively, TouchGold Bengals may elect to pay the cost of medications if the Buyer agrees.  The cost of examinations and office visits are the responsibility of the Buyer.  The cost of transportation of the replacement kitten is the responsibility of TouchGold Bengals.

 

TouchGold Bengals guarantees the kitten against fatal congenital defects up to one year of age.  If the kitten dies as a result of a congenital defect before one year of age, a replacement kitten as described above in the “Health” paragraph will be provided to the Buyer.  Buyer must provide TouchGold Bengals with a written necropsy report signed by a licensed veterinarian, which states in no uncertain terms that death was caused by a specified congenital defect.  Tissue samples and/or photographs supporting the diagnosis will be required for examination by a veterinarian of TouchGold Bengals’ choice, and said veterinarian must confirm the diagnosis in order to rule out death by injury or illness of a non-congenital nature.  Failure to provide this documentation within two weeks of the kitten’s death will void this guarantee.

 

Contact by the kitten with any other animal, including pets owned by the Buyer, during this seven-day period will void this guarantee.

 

This kitten has been examined by F. Thomas Miller, VMD, Pocono Lake Animal Hospital, on  

and found to be free of disease and congenital defects, except as noted below:

 

 

 

TouchGold Bengals will provide the Buyer with a written Health Record containing dates and type of vaccinations, fecal examinations and history of any illness that has occurred, as well as any treatment or medications given.

 

SPAY/NEUTER:  Breeding rights are NOT included in the purchase price of this kitten.  Buyer agrees to have the kitten spayed or neutered before six months of age.  Upon receipt or written verification by a Veterinarian that this procedure has been done, TouchGold Bengals will provide the Buyer with a $50 rebate of the purchase price, pedigree, and TICA registration form.  This rebate is given in the spirit of preventing overpopulation of both unwanted pets in animal shelters and free-roaming feral cats.

The Buyer is advised that kittens may reach sexual maturity BEFORE six  months of age, and all care must be taken to prevent contact by the kitten with unneutered cats.

 

CARE AND FEEDING:  Buyer agrees to keep the kitten indoors at all times unless wearing a harness and accompanied by a responsible person.  Buyer agrees to prevent the kitten from harboring parasites such as fleas, ear mites and intestinal worms, and to provide prompt treatment should an infestation occur.  The kitten must have access to fresh water at all times, and free-choice feeding of a premium dry cat food such as Eukanuba, Iams, Nutro, Professional, ProPlan, or Science Diet is highly recommended.  Premium canned cat food may be offered on occasion, but is not a recommended staple diet as it may allow tartar to form on the teeth, resulting in periodontal disease.  While in the possession of TouchGold Bengals,  this kitten has been fed:  Nutro Natural Choice Complete Care – Kitten Formula.

                                                                                                                                                                                                               

Buyer agrees to provide prompt medical attention when needed, including annual health checks and booster vaccinations.

Buyer agrees to provide the kitten with companionship and affection, and not to confine it to a cage or other containment for prolonged periods of time.

 

 

 

TRANSFER OF OWNERSHIP:  Buyer agrees not to give or sell the kitten to an animal shelter, or to any person or facility engaging in animal testing or experimentation.  If at any time the Buyer cannot keep or no longer wants to keep the kitten, TouchGold Bengals will be given the right of first refusal before the kitten is given away or offered for sale to any other person.  If it is not possible for TouchGold Bengals to accept return of the kitten, assistance will be offered in finding a suitable home.  If TouchGold Bengals accepts return of the kitten, and it is subsequently resold, Buyer will receive the proceeds of the sale minus any expenses incurred by TouchGold Bengals.

 

 

The legal jurisdiction for this contract shall remain in the County of Monroe, State of Pennsylvania, regardless of the last signature and/or the subsequent state in which it was signed.
